Guibai Gatama after being ousted from the Fecafoot Executive Committee, he has started proceedings at Court of Arbitration for sports Court of Arbitration of Sports ( CAS) to have the current president removed from office.
A former member of the Executive Committee (Comex) of the Cameroon Football Federation Guibaï Gatama , was at the headquarters of the Court of Arbitration for Sport (CAS) in Lausanne, Switzerland yesterday. On his Facebook page, he left a short message about his presence in Switzerland.
“The hearing on “The vacancy in the presidency of Fecafoot following the sentencing of President Eto’o to 22 months in prison in Spain” was completed at CAS in Lausanne. Always fight your battles to the end“. wrote the journalist and Director of Publication of the newspaper L’Œil du Sahel.
In his view, Samuel Eto’o’s 22-month prison sentence in Spain rendered him ineligible for the post of Fecafoot president. This was in accordance with the texts in force.
However, it is feared that Guibaï Gatama’s appeal will not be successful. Indeed, the modification of Fecafoot’s statutes by the new executive will allow the current president to continue his mandate and stand for re-election. According to article 36 of the new statutes, relating to the general conditions of eligibility, paragraph 1.b states that any candidate for an elective position must not have “been sentenced to a final custodial sentence accompanied by a detention order”.
This new provision is tailor-made for Samuel Eto’o. Paragraph 1.d of former Article 36 stipulated that “any citizen who has been sentenced to a final custodial sentence with a suspended sentence or probation of more than six months may not be a candidate”.
